Mendon Conservation Commission imposes $4,500 fine after unauthorized wetland clearing at vernal pool site. The commission voted unanimously at its July 16 meeting to fine property owner DNF Alfonso $4,500 for 15 violations of two active orders of conditions at 27 and 29 Pleasant Street, covering DEP permits 218-0860 and 218-0861. Conservation Agent Isabella documented that tree clearing began on July 7 without a pre-construction meeting, sediment controls, advance notice to the agent, or a turtle sweep required by National Heritage and Endangered Species Program conditions — and that work continued the following morning after a verbal stop-work order had been issued.

The commission structured the fine at $150 per violation across both permits after a 3-to-3 tie vote defeated a motion to double the fine by treating the two adjacent properties separately. The commission also issued an enforcement order requiring a licensed herpetologist — wildlife biologist Brian Rosine, who appeared at the meeting — to conduct a turtle sweep under commission supervision before any machinery moves or clearing resumes, and directing the applicant to install siltation and symbolic fencing, hold the required pre-construction meeting, and fulfill all remaining NHESP conditions including permanent boundary monumentation. NHESP has separately opened its own state-level investigation into the violations.
